This article addresses the fiduciary issues raised by the current practice of plan fiduciaries of not only disclaiming any fiduciary responsibility for brokerage window investments, but also abdicating any role (fiduciary or otherwise) in assessing even the general suitability of those investments for a retirement plan, and concludes that the practice is in plain and notorious violation of what ERISA requires of fiduciaries.

In this article I propose to understand inertia in art as a “disposition to meaning”. I compare inertia in art with that of a face of a person recently deceased. To acquaintances, i.e. to family and friends, it holds a promise of memories (of the deceased); to all the others the corpse offers the possibility of a projection of meanings. Art is made of plain, or extra-ordinary stuff, which is turned into artistic material. The artist is to bring the inert (...) potency of stuff to artistic life, and to turn it into something that is expressive. If she is successful, then the work will offer its audience a concentrated, absorbing experience. Art is autonomous in that the aimed for experience is morally neutral. In the view of many contemporary artists, such experiences fail art’s deeper significance: absorbing experiences are, simply, too easy. If artists want to really move the audience (to emotion), or so they feel, they should also move the audience into action. Wanting to achieve this is not just difficult; it is a paradox. (shrink)

El estudio y análisis de las argumentaciones cotidianas entendidas como interacciones discursivas e intencionales encaminadas a dar cuenta de algo con el fin de lograr que aquello que se sostiene sea aceptado, sería inconcebible sin la aparición de la teoría de los actos de habla de Austin (1962), la propuesta de Searle (1969), el trabajo de Grice sobre la teoría de la conversación (1975) y el importante estudio sistemático de Hamblin sobre el argumento falaz (1970). Como una reelaboración de dichas (...) obras cabe entender la teoría pragmadialéctica de la argumentación propuesta inicialmente por Frans H. van Eemeren y Rob Grootendorst (1984). Algunos autores (Blair, 2006: 11; Woods, 1992) creen ver en ella, más que una teoría, una amalgama de varias teorías y una particular versión de la teoría pragmadialéctica de la argumentación, entendiendo ésta bajo una acepción más general. Aesthics: Art and moral attuning. Art can help us understand everyday moral deliberation. Better perhaps than ethics. People don’t just act randomly in moral situations nor do they argue internally about which ethical principle to follow before deciding what to do. We built our moral sensitivity whilst living our lives, adhering to aesthetic norms of interaction. Regular engagement with works of art educates our moral sensitivity.

Iconic photographs are visual arguments depicting an, often dramatic, particular situation showing victims of disasters. Spectators watching the photo of the particular situation, empathise with it, and project the feelings evoked onto the events that form the context for the scene in the picture. This mobilises them into political action. In the process, however, the depicted personal misery is perused to exemplify the larger events. The tragedy of iconic photographs is analysed not as the misery experienced by the depicted persons, (...) but as the breach of their right to shame which is required for the photo to acquire iconicity. Examples are addressed, as well as the contrast classes of the self-portrait and Byzantine icons. (shrink)

According to the principle that ‘ought’ implies ‘can’, it is never the case that you ought to do something you cannot do. While many accept this principle in some form, it also has its share of critics, and thus it seems desirable if an argument can be offered in its support. The aim of this paper is to examine a particular way in which the principle has been defended, namely, by appeal to considerations of fairness. In a nutshell, the idea (...) (due to David Copp) is that moral requirements we cannot comply with would be unfair, and there cannot be unfair moral requirements. I discuss several ways of spelling out the argument, and argue that all are unsatisfactory for a variety of reasons. (shrink)

David Enoch recently defended the idea that there are valid inferences of the form ‘it would be good if p, therefore, p’. I argue that Enoch's proposal allows us to infer the absurd conclusion that ours is the best of all possible worlds.

In its recent opinion in Intel v. Sulyma, the U.S. Supreme Court clarified what qualifies as the “actual knowledge” required to trigger ERISA’s three-year statutory period. The Court’s opinion, however, left open whether establishing “actual knowledge” by a plaintiff in one case serves to time-bar otherwise timely suits that challenge subsequent breaches of the same character. This article argues that, under the continuing fiduciary duty analysis that the Court set forth in Tibble v. Edison, such suits should not be deemed (...) untimely. (shrink)

There are two distinct views on how to formulate an objective consequentialist account of the deontic status of actions, actualism and possibilism. On an actualist account, what matters to the deontic status of actions is only the value of the outcome an action would have, if performed. By contrast, a possibilist account also takes into account the value of the outcomes that an action could have. These two views come apart in their deontic verdicts when an agent is imperfect in (...) an avoidable way, viz., when agent brings about less good than she could. In this paper, I offer an argument against actualism that draws on the connection between moral obligation and practical reasons. (shrink)

In this position paper, we describe a number of methodological and philosophical challenges that arose within our interdisciplinary Digital Humanities project CatVis, which is a collaboration between applied geometric algorithms and visualization researchers, data scientists working at OCLC, and philosophers who have a strong interest in the methodological foundations of visualization research. The challenges we describe concern aspects of one single epistemic need: that of methodologically securing (an increase in) trust in visualizations. We discuss the lack of ground truths in (...) the (digital) humanities and argue that trust in visualizations requires that we evaluate visualizations on the basis of ground truths that humanities scholars themselves create. We further argue that trust in visualizations requires that a visualization provides provable guarantees on the faithfulness of the visual representation and that we must clearly communicate to the users which part of the visualization can be trusted and how much. Finally, we discuss transparency and accessibility in visualization research and provide measures for securing transparency and accessibility. (shrink)

Some moral theories, such as objective forms of consequentialism, seem to fail to be practically useful: they are of little to no help in trying to decide what to do. Even if we do not think this constitutes a fatal flaw in such theories, we may nonetheless agree that being practically useful does make a moral theory a better theory, or so some have suggested. In this paper, I assess whether the uncontroversial respect in which a moral theory can be (...) claimed to be better if it is practically useful can provide a ground worth taking into account for believing one theory rather than another. I argue that this is not the case. The upshot is that if there is a sound objection to theories such as objective consequentialism that is based on considerations of practical usefulness, the objection requires that it is established that the truth about what we morally ought to do cannot be epistemically inaccessible to us. The value of practical usefulness has no bearing on the issue. (shrink)

Under a policy first enacted in 1988 and expanded in 1996, federally funded public housing authorities (“PHAs”) and private landlords renting their properties to tenants receiving federal housing assistance have been required to include a provision in all leases under which drug-related criminal activity as well as criminal activity that in any way poses a threat to other tenants or nearby residents constitutes ground for initiating eviction proceedings. This strict liability eviction policy, which has become known as the “One-Strike Rule,” (...) was part of a broader congressional effort to combat the “reign of terror” that Congress believed drug dealers were imposing on public housing and assisted housing tenants. Like many of the crime-related policies enacted in the 1980s and 1990s, the One-Strike Rule has done little to reduce crime rates, but has been wildly successful in ensuring that the situation of poor households receiving federal assistance remains highly precarious. Calls for reform of the One-Strike Rule are almost as old as the policy itself, but given the political outlook of the current administration, the prospects for reform at the federal level are dim. While federal law and a combination of gridlock and unwillingness in the congressional and executive branches foreclose a range of possible strategies for reform, there is nonetheless room to mitigate the socially corrosive effects of the One-Strike Rule through legislative efforts at the state and local level. Courts in various jurisdictions have upheld state laws that protect vulnerable tenants despite the federal strict liability policy, and these holdings help to provide a framework for how state and local governments seeking to protect tenants can do so without their efforts necessarily falling prey to the Supremacy Clause. This article describes that framework and proposes three concrete measures that fit it. The article is structured as follows: after explaining the One-Strike Rule and the threat it poses to vulnerable tenants (Section II), the article discusses the burden the Rule imposes on tenants and the benefits it is supposed to bring to other parties, and argues that the resulting distribution of burdens and benefits is unjust (Section III). The article then lays out three concrete measures that state and local governments can enact to protect tenants who face eviction for criminal activity under the Rule without falling prey to a federal preemption challenge: requiring “good cause” for eviction, giving tenants the right to cure a breach of their lease, and providing tenants with free counsel in landlord-tenant court (Section IV). The characterization of objective, normative reasons to φ as facts (or truths) that count in favor of φ-ing is widely accepted. But are there any further conditions that considerations which count in favor of φ-ing must meet, in order to count as a reason to φ? In this brief paper, I consider and reject one such condition, recently proposed by Caspar Hare.

A naturalistic theory of intentionality is proposed that differs from previous evolutionary and tracking theories. Full-blown intentionality is constructed through a series of evolvable refinements. A first, minimal version of intentionality originates from a conjectured internal process that estimates an organism’s own fitness and that continually modifies the organism. This process produces the directedness of intentionality. The internal estimator can be parsed into intentional components that point to components of the process that produces fitness. It is argued that such intentional (...) components can point to mistaken or non-existing entities. Different Fregian senses of the same reference correspond to different components that have different roles in the estimator. Intentional components that point to intentional components in other organisms produce directedness towards semi-abstract entities. Finally, adding a general, population-wide means of communication enables intentional components that point to fully abstract entities. Intentionality thus naturalized has all of its expected properties: being directed; potentially making errors; possibly pointing to non-existent, abstract, or rigid entities; capable of pointing many-to-one and one-to-many; distinguishing sense and reference; having perspective and grain; and having determinate content. Several examples, such as ‘swampman’ and ‘brain-in-a-vat’, illustrate how the theory can be applied. (shrink)

Cellular, or mobile phones are great: they allow people to communicate over long distances whenever and wherever they are, and instantaneously at that when the one called is wearing one too. Having said that, though, it must immediately be added that they, also, have a complex disadvantage, and it is one we are hard pushed to understand. In fact, due to its complexity people simply tend to neglect it, even though everyone in his right mind has had experience with it. (...) Now Walter Benjamin defined aura as “a distance however close it may be”.1) This has standardly been interpreted as a characterisation of an experience of presence, also by Benjamin. This aura supposedly suffered from the rise of photography. Aura can, also, be understood as inertia, the absence of something present. And whether aura is gone or widespread I gladly leave to more speculative-minded thinkers. I submit that we experience a person’s “aura”—her distance however close she may be—when perception tells us the person is present yet our mind realises that she isn’t. I am referring here to the observation had of another person engaged in a cell phone conversation. The inertia of the cell phone caller consists in her incapacity to address those who observe her. I think there is an immoral streak to her selfappointed moral autonomy. In a previous edition of this Dutch-Russian exchange on inertia I argued that our trafficking with facial expressions forms the model with which we’d best understand the workings of art—facial expression is the anthropological foundation of art. My discussion, today, of the cell phone conversation is meant to add to that previous suggestion. (shrink)

A philosophical analysis of the future of art must explicate art’s nature, as well as discuss the historical nature of art practice. Only so can one explain those contemporary developments in art which have led many people to doubt whether art even has a future. Arguably, art practice as we know it started with the installing of the modern system of the fine arts. I explain the pragmatics of art so understood, and suggest that we can define art, internally. We (...) need not resort to a nominalist approach that claims that something is a work of art if some representative of the art world says it is. Instead of such empty proceduralism, I explain how all art’s focal objects, persons and activities are mutually adjusted and can only be understood in light of the whole. Within that whole of art practice, the contemporary samples of art’s alleged failure can be assessed. Now the modern system treats the arts as aesthetic, and prescribes that to judge a work one has to experience it for oneself. Why this should be so, I explain in terms of the perceivability of the artist in the work. Next, art develops as a whole rather than in a piecemeal manner. Particular contemporary works may alienate the audience from art practice, yet once they are recognisably in a procedure which has clear artistic potency they can be incorporated fruitfully in the modern system as explained. In all, the future of art is the future of the modern system, unless the system as a whole goes. We see this happen with the Taliban, but do not ourselves seem to be vulnerable to such onslaught. Yet, our culture may be in the process of eliminating the human mind from the objective reality, and if nothing stops us, art too will come to an end. Luckily, by then we will not be such as to lament that demise. (shrink)

The causal efficacy of a material system is usually thought to be produced by the law-like actions and interactions of its constituents. Here, a specific system is constructed and explained that produces a cause that cannot be understood in this way, but instead has novel and autonomous efficacy. The construction establishes a proof-of-feasibility of strong emergence. The system works by utilizing randomness in a targeted and cyclical way, and by relying on sustained evolution by natural selection. It is not vulnerable (...) to standard arguments against strong emergence, in particular ones that assume that the physical realm is causally closed. Moreover, it does not suffer from epiphenomenalism or causal overdetermination. The system uses only standard material components and processes, and is fully consistent with naturalism. It is discussed whether the emergent cause can still be viewed as ‘material’ in the way that term is commonly understood. (shrink)

A new theory that naturalizes biological function is explained and compared with earlier etiological and causal role theories. Etiological theories explain functions from how they are caused over their evolutionary history. Causal role theories analyze how functional mechanisms serve the current capacities of their containing system. The new proposal unifies the key notions of both kinds of theories, but goes beyond them by explaining how functions in an organism can exist as factors with autonomous causal efficacy. The goal-directedness and normativity (...) of functions exist in this strict sense as well. The theory depends on an internal physiological or neural process that mimics an organism’s fitness, and modulates the organism’s variability accordingly. The structure of the internal process can be subdivided into subprocesses that monitor specific functions in an organism. The theory matches well with each intuition on a previously published list of intuited ideas about biological functions, including intuitions that have posed difficulties for other theories. Metaphors for describing the introduction, impacts, and management of non-native species are numerous and often quite outspoken. Policy-makers have adopted increasingly disputed metaphorical terms from scientific discourse. We performed a critical analysis of the use of strong metaphors in reporting scientific findings to policy-makers. Our analysis shows that perceptions of harm, invasiveness or nativeness are dynamic and inevitably display multiple narratives in science, policy or management. Improving our awareness of multiple expert and stakeholder narratives that exist in the context of (...) non-native species management, as well as metaphorical alternatives, is critical. (shrink)

The Centre for Society and Genomics (CSG) was established in 2004, funded by NGI (the Netherlands Genomics Initiative). Funding was continued in 2008. This report summarises the basic outcomes of almost a decade of interactive societal research, in close collaboration with the other centres of the NGI network. There are two reasons for presenting these results. First of all, at the end of this year, the CSG Next programme (2008-2013), encompassing more than 50 research projects conducted at 10 Dutch universities, (...) will be completed. Moreover, we are currently preparing ourselves for the years to come. The network of principal investigators, together with the research communities they represent and the societal and international networks they are involved in, have agreed to continue to work together, on the basis of mutual learning, transdisciplinary collaboration and collegial support. Notably, we offer our networks, experiences and expertise to help prepare the ground for promoting Responsible Research and Innovation (RRI) in the context of Horizon2020, together with our European colleagues. This report summarises what our type of research can achieve and how we want to continue our activities in the future. After a concise sketch of the life sciences landscape as it has evolved during the past seven decades or so, we explain how CSG came about and what kind of approach we have developed. Subsequently, we list our main results, notably in the form of project vignettes, so as to make the harvest of the CSG Next programme as tangible and concrete as possible. Finally, we explain how we see our role in the future. As is already indicated by the title: this is not merely a retrospective summary of our results (CSG harvest), but an invitation to readers (from academia, industry, policy and civil society) to reassemble and to optimally prepare ourselves for things to come, by strengthening and broadening our collaborative efforts, building on what we have achieved so far. Many philosophers think the distinctive function of deontic evaluation is to guide action. This idea is used in arguments for a range of substantive claims. In this paper, we entirely do one completely destructive thing and partly do one not entirely constructive thing. The first thing: we argue that there is an unrecognized gap between the claim that the function of deontic evaluation is to guide action and attempts to put that claim to use. We consider and reject four arguments (...) intended to bridge this gap. The interim conclusion is thus that arguments starting with the claim that the function of deontic evaluation is to guide action have a lacuna. The second thing: we consider a different tack for making arguments of this sort work. We sketch a methodology one could accept that would do the trick. Unfortunately, as we’ll explain, although this methodology would bridge the gap in arguments that put claims about the function of deontic evaluation to work, it would do so in a way that vitiates any interest we might have in such arguments. As an aside, we’ll also point out how epistemologists, who have recently become interested in the function of epistemic evaluation, appear to already recognize this fact. The conclusion is hence a dilemma: either arguments from deontic function to substance have a lacuna or such arguments lack teeth. (shrink)

The book is an “introductory” reconstruction of Davidson on interpretation —a claim to be taken with a grain of salt. Writing introductory books has become an idol of the tribe. This is a concise book and reflects much study. It has many virtues along with some flaws. Ramberg assembles themes and puzzles from Davidson into a more or less coherent viewpoint. A special virtue is the innovative treatment of incommensurability and of the relation of Davidson’s work to hermeneutic themes. The (...) weakness comes in a certain unevenness. While generally convincing and well written, the book has low points which may leave the reader confused or unconvinced. Davidson is the hero in this book, and our hero is sometimes over idealized. A recently developed computational and neurobiological theory of phenomenal consciousness is applied to a series of persistent philosophical problems of consciousness (in recent formulations by Tye, Searle, and Chalmers). Each problem has a clear solution according to this theory, as is briefly explained here. The origin and development of consciousness is poorly understood. Although it is clearly a naturalistic phenomenon evolved through Darwinian evolution, explaining it in terms of physicochemical, neural, or symbolic mechanisms remains elusive. Here I propose that two steps had to be taken in its evolution. First, living systems evolved an intrinsic goal-directedness by internalizing Darwinian fitness as a self-estimated fitness. The self-estimated fitness participates in a feedback loop that effectively produces intrinsic meaning in the organism. Second, animals with advanced nervous (...) systems evolved a special form of communication that modifies the way each partner estimates fitness. The resulting change in intrinsic meaning is experienced subjectively as a primary form of consciousness. This primary form is subsequently used to generate, partly through internalized dialogue, more complex forms of consciousness, such as consciousness of the natural and social worlds, consciousness of the self, and language-dependent forms of consciousness. Recently developed extensions of evolutionary theory are used to explain the human self as an evolved, unitary, and purposeful phenomenon. A basic mechanism that can generate life's agency and goal-directedness is combined with mechanisms that can account for awareness by and of the self, and for the social characteristics of humans. The new theory is largely consistent with major existing theories of the self, in particular theories centred on self-esteem, self-determination theory, and terror management theory. It can therefore be regarded (...) as a meta-theory that brings these theories, and related ones, within a common evolutionary framework. The theory suggests two primary dimensions of the self, the depth of awareness of the self and the social extent of the self. Background: Critically ill patients often require complex clinical care by highly trained staff within a specialized intensive care unit (ICU) with advanced equipment. There are currently limited data on the costs of critical care in low-and middle-income countries (LMICs). This study aims to investigate the direct-medical costs of key infectious disease (tetanus, sepsis, and dengue) patients admitted to ICU in a hospital in Ho Chi Minh City (HCMC), Vietnam, and explores how the costs and cost drivers can vary between the (...) different diseases. -/- Methods: We calculated the direct medical costs for patients requiring critical care for tetanus, dengue and sepsis. Costing data (stratified into different cost categories) were extracted from the bills of patients hospitalized to the adult ICU with a dengue, sepsis and tetanus diagnosis that were enrolled in three studies conducted at the Hospital for Tropical Diseases in HCMC from January 2017 to December 2019. The costs were considered from the health sector perspective. The total sample size in this study was 342 patients. -/- Results: ICU care was associated with significant direct medical costs. For patients that did not require mechanical ventilation, the median total ICU cost per patient varied between US$64.40 and US$675 for the different diseases. The costs were higher for patients that required mechanical ventilation, with the median total ICU cost per patient for the different diseases varying between US$2,590 and US$4,250. The main cost drivers varied according to disease and associated severity. -/- Conclusion: This study demonstrates the notable cost of ICU care in Vietnam and in similar LMIC settings. Future studies are needed to further evaluate the costs and economic burden incurred by ICU patients. The data also highlight the importance of evaluating novel critical care interventions that could reduce the costs of ICU care. (shrink)

Een vrije en veerkrachtige samenleving ontstaat niet vanzelf en blijft niet vanzelf bestaan. In dit themanummer verkennen we de publieke onderwijstaak van het hoger beroepsonderwijs om studenten te onderwijzen de gemeenschappelijke wereld én het publieke gesprek over die wereld centraal te stellen. Met dit themanummer willen wij iets tegenover het vigerende marktdenken zetten. We laten ons hierbij inspireren door het gedachtegoed van Hannah Arendt (1906–1975). Ze heeft uitgebreid geschreven over ‘het publieke’. Ze verbindt de inzet van wetenschappelijke kennis en technologie (...) met het politieke vraagstuk: willen we daadwerkelijk leven in de wereld die we aan het scheppen zijn? Arendts gedachtegoed biedt volop handvatten om op verschillende niveaus van het hoger beroepsonderwijs deze taak te doordenken en invulling te geven. (shrink)

Wat betreft economische groei en ontwikkeling van de werkloosheid heeft de Nederlandse economie het sinds 1973 slechter gedaan dan andere OECD-landen. Op de vraag naar de oorzaken van die slechte prestatie zijn in het verleden uiteenlopende antwoorden gegeven door o.m. Bomhoff en Clavaux. Ook zijn er diverse wegen aangegeven om op te rukken naar een betere positie. In dit artikel presenteren de auteurs de resultaten van een internationale doorsnee-analyse om de verschillen in economisch succes tussen landen met behulp van een (...) eenvoudig neo-klassiek macro-economisch model te verklaren. Dit biedt de mogelijkheid om te traceren wat de rol van de exportgroei, de groei van de bevolking, de wisselkoers, de verhouding tussen de binnenlandse en de buitenlandse prijsontwikkeling en de investeringsquote voor verschillen in economische ontwikkeling is geweest. Vooral de uitvoer gecorrigeerd voor de omvang van de bevolking, de investeringsquote en de nominale wisselkoers komen als belangrijke verklarende variabelen naar voren. Op grond van hun analyse komen de auteurs tot de conclusie dat een beleid gericht op het verbeteren van de Nederlandse economische prestatie op lange termijn zich vooral zou moeten concentreren op het benutten van exportkansen en op een hoog investeringsniveau ter bevordering van technologische vernieuwing en daarmee verbetering van de concurrentiepositie. Daarbij moet worden voorkomen dat revaluatie van de gulden het exporteffect teniet doet. (shrink)

Rob Lovering has recently argued that since theists have been unable, by means of philosophical arguments, to convince 85 percent of professional philosophers that God exists, at least one of their defining beliefs must be either false or meaningless. This paper is a critical examination of his argument. First we present Lovering’s argument and point out its salient features. Next we explain why the argument’s conclusion is entirely acceptable for theists, even if, as we show, there are multiple problems with (...) the premises. (shrink)

Hij was de Nederlandse vertegenwoordiger van een belangrijke Europese stroming in de filosofie: de historische fenomenologie. In de jaren zeventig raakte hij echter in conflict met zijn tijd. Terwijl de Nederlandse publieke opinie een wending naar links doormaakte, bond Van den Berg de strijd (...) aan tegen verloedering, hooliganisme en anarchisme. Dit ging ten koste van zijn populariteit, maar niet van zijn productiviteit, noch van zijn innovativiteit. Tot op de dag van vandaag werkt hij aan een indrukwekkend , panoramisch oeuvre. Hij is de belangrijkste Nederlandse filosoof sinds Bolland. -/- Deze studie wil het werk van Van den Berg reconstrueren, situeren en beoordelen. Reconstrueren door de methodische en thematische coherentie ervan zichtbaar te maken. Situeren door het te confronteren met dat van andere, verwante auteurs zoals Husserl, Freud, Bachelard en Foucault. Beoordelen door na te gaan in hoeverre Van den Berg de inzet van zijn project, zowel inhoudelijk als methodologisch, waarmaakte. -/- Het werk van Van den Berg is geen curiosum, maar opvallend actueel. Hij onderzoekt het begin, de aanvang van wetenschappelijke en maatschappelijke ontwikkelingen waarvan het belang in de huidige situatie met nadruk zichtbaar wordt. Zijn beeldende stijl wekt de geschiedenis van de wetenschap tot leven, maar werd vaak als ‘anekdotisch’ afgedaan; zijn talent voor polemiek lokte soms felle reacties uit en zijn methodologische flexibiliteit maakte hem een gemakkelijk doelwit van academische kritiek. Aan de positieve kant van de balans staan echter zijn intellectuele enthousiasme en zijn internationale faam. Zijn werk verdient een rehabilitatie. (shrink)

The force law of Maxwell’s classical electrodynamics does not agree with Newton’s third law of motion (N3LM), in case of open circuit magnetostatics. Initially, a generalized magnetostatics theory is presented that includes two additional physical fields B_Φ and B_l, defined by scalar functions. The scalar magnetic field B_l mediates a longitudinal Ampère force that balances the transverse Ampère force (aka the magnetic field force), such that the sum of the two forces agrees with N3LM for all stationary current distributions. Secondary (...) field induction laws are derived; a secondary curl free electric field E_l is induced by a time varying scalar magnetic field B_l, which isn’t described by Maxwell’s electrodynamics. The Helmholtz’ decomposition is applied to exclude E_l from the total electric field E, resulting into a more simple Maxwell theory. Decoupled inhomogeneous potential equations and its solutions follow directly from this theory, without having to apply a gauge condition. Field expressions are derived from the potential functions that are simpler and far field consistent with respect to the Jefimenko fields. However, our simple version of Maxwell’s theory does not satisfy N3LM. Therefore we combine the generalized magnetostatics with the simple version of Maxwell’s electrodynamics, via the generalization of Maxwell’s speculative displacement current. The resulting electrodynamics describes three types of vacuum waves: the Φ wave, the longitudinal electromagnetic (LEM) wave and the transverse electromagnetic (TEM) wave, with phase velocities respectively a, b and c. Power- and force theorems are derived, and the force law agrees with Newton’s third law only if the phase velocities satisfy the following condition: a >> b and b = c. The retarded potential functions can be found without gauge conditions, and four retarded field expressions are derived that have three near field terms and six far field terms. All six far field terms are explained as the mutual induction of two free fields. Our theory supports Rutherford’s solution of the 4/3 problem of electromagnetic mass, which requires an extra longitudinal electromagnetic momentum. Our generalized classical electrodynamics might spawn new physics experiments and electrical engineering, such as new photoelectric effects based on Φ- or LEM radiation, and the conversion of natural Φ- or LEM radiation into useful electricity, in the footsteps of dr. N. Tesla and dr. T.H. Moray. (shrink)

This article examines whether Willard Van Orman Quine’s indeterminacy thesis can be sustained. The argument from above, Quine argues, can derive indeterminacy as its conclusion. I will argue that the indeterminacy claim cannot be sustained. I further argue that Quine changed the formulation of the underdetermination of theory by evidence (UTE) argument from what Duhem said to the Quine/Pierce meaning verification view, in order use the new formulation of UTE to imply indeterminacy. Given all that, we see when we apply (...) the old UTE argument we only arrive at underdetermination of theory by evidence, and that applies to all sciences, philosophy and knowledge, including philosophy of language. Frans H. van Eemeren y Peter Houtlosser reaccionaron contra una separación estricta entre dialéctica y retórica en varios trabajos, pero uno de los más inspiradores es sin duda su artículo “William the Silent’s argumentative discourse” (1998) presentado en la ciudad de Ámsterdam con ocasión de la cuarta conferencia organizada (...) por la International Society for the Study of Argumentation (ISSA). Sobre este tema siguieron investigando para presentar un análisis de la perspectiva dialéctica inherente al caso de Guillermo I de Orange en un congreso de la Japan Debate Association en Tokio (van Eemeren y Houtlosser, 2000). This paper investigates a well-known case of simultaneous discovery in twentieth-century chemistry, the origins of the concept of hybridisation, in the light of Kuhn's insights. There has been no ambiguity as to who discovered this concept, when it was "rst in print, and how important it was. The full-#edged form of the concept was published in 1931 independently by two American scientists John C. Slater (1900}1976) and Linus Pauling (1901}1994), although both of them had made their ideas public earlier: Slater (...) at the American Physical Society meetings in 1930, and Pauling in the Proceedings of the National Academy of Sciences in 1928. Slater and Pauling both argued for the necessity of using an s orbital as well as three p orbitals in the carbon atom in order to explain carbon's four valences and the tetrahedral structure of methane. The metaphor &hybridisation' for denoting this mix of s and p orbitals was "rst used by Robert S. Mulliken and J. H. Van Vleck before gaining currency with the scienti"c community around 1935.2 The concept of hybridisation was indeed indispensable for extending the quantum-mechanical interpretation of the chemical bond as an electron pairing from diatomic molecules to polyatomic ones. To be sure, the emergence of hybridisation attests to scientists' growing interest in exploring the borderland between physics and chemistry, a trend that led to the creation of physical chemistry in the late nineteenth century and of chemical physics and quantum chemistry in the 1920s and 30s. Slater and Pauling themselves experienced and on many occasions talked about the fruitfulness of interdisciplinary research; and historians have legitimately illuminated their works by examining them in this broad context.3 Yet the careful analysis of their research notes and published papers reveals that Slater and Pauling were working in quite disparate disciplinary traditions, with di!erent approaches, for di!erent audiences, and towards di!erent goals. The aim of this paper is to explore their di!erent routes to a common destination*hybridisation*and thereby to explicate tensions existing between physics and chemistry amidst the institutional and conceptual overlapping of the two disciplines. Adam Elga takes the Sleeping Beauty example to provide a counter-example to Reflection, since on Sunday Beauty assigns probability 1/2 to H, and she is certain that on Monday she will assign probability 1/3. I will show that there is a natural way for Bas van Fraassen to defend Reflection in the case of Sleeping Beauty, building on van Fraassen’s treatment of forgetting. This will allow me to identify a lacuna in Elga’s argument for 1/3. I will then argue, however, (...) that not all is well with Reflection: there is a problem with van Fraassen’s treatment of forgetting. Ultimately I will agree with Elga’s 1/3 answer. David Lewis maintains that the answer is 1/2; I will argue that cases of forgetting can be used to show that the premiss of Lewis’s argument for 1/2 is false. (shrink)

In a recent paper, Nate Sharadin and Rob van Someren Greve pull into doubt a seemingly platitudinous idea: deontic evaluation is capable of guiding action (“Capable”). After discussing several arguments for it, the authors conclude that, to the extent to which Capable can be defended, it cannot produce interesting results about the nature of the deontic. My goal is to argue that the authors’ skeptical endeavors are unconvincing. I aim to show that they rely on an implausibly broad understanding of (...) “actual guidance”. I propose an alternative understanding and show that, with it, “functionalist” arguments of the above kind can produce interesting results. If I am right, Sharadin’s and van Someren Greve’s considerations do not get off the ground. Instead, optimism seems warranted: We can learn something interesting about the nature of the deontic by assuming that actual guidance is the function of deontic evaluation. (shrink)

Amie Thomasson challenges advocates of layered conceptions of reality to explain “how layers are distinguished” and “what holds them together” by “examining the world” (2014). One strategy for answering such questions is mereological, treating inter-layer relations as parthood relations, where layers exist whenever composition does, and the number of layers will be equivalent to the number of answers to Peter Van Inwagen’s Special Composition Question, while answers to his General Composition Question explain what holds the layers together (1987). Various answers (...) have been proffered for these questions, from the physicalist atomism of Richard Feynman (2015), Hilary Putnam (1958), and Kit Fine (1992) to the holism of Jonathan Schaffer (2010), the two-layer emergentism of Van Inwagen himself (1995), Tim Maudlin’s three-layered “flash ontology” (2011), and Rob Koons two-layered “thermal substances” (2019). In this PhD project, I seek to meet Thomasson’s challenge by identifying which of these proposals are compatible with plausible interpretations of quantum physics. Atomist answers may have difficulty with relativity, while holistic and emergentist models have trouble giving an account of experimental conditions. Maudlin and Koons’ views, meanwhile, may make testable predictions about the scope of entanglement. Examining the world can lead us to sharply winnow our theories about how layers are distinguished and what holds them together. (shrink)
